Client Success Story: F1 Visa to Green Card based on Marriage

Xu Law Group immigration attorney Toni Xu recently received approval of a I-485 petition to adjust status to permanent residency for a client from China. This I-485 petition was approved in under 1 year without a request for additional evidence being issued by the U.S. Citizenship and Immigration Service (USCIS).

Like many foreign nationals who came to the U.S. on a F-1 Student Visa, the client studied at an elite university and fell in love with a U.S. born citizen. However, the client overstayed her F-1 student visa and did not timely file for the OPT extension. The Client was anxious that her out-of-status situation would jeopardize any green card application based on marriage.

Xu Law Group stepped in and clarified the legal nuances and cleared the legal hurdles to prove the client’s eligibility to adjust status. In addition to the Green Card, we helped her apply for a I-765 work authorization and I-131 advance parole so she may work and travel while the green card is pending. With the I-485 approval, the client is now legally a permanent resident of the United States.

If you are a F-1 visa holder or other B-2 visa holder seeking permanent residency based on your marriage to a U.S. citizen or permanent resident and need more information on marriage green card process, schedule a consultation today with a Xu Law Group attorney.
