For FY 2023, USCIS received 483,927 H-1B visa registrations and selected about 26% in the first round. If you are wondering why this visa is so popular, here are the reasons.

General Requirements

H1B visa has general qualifications requirements. While many other working visas require the beneficiary to have an advanced degree, professional background, or investment capability, the H-1B simply requires that the candidate has:

  • A bachelor’s degree;

  • A job offer from a U.S. company for a specialty position that requires your bachelor’s degree;

Dual Intent Visa

One of the H-1B’s many benefits is the fact that it is considered to be a “dual intent” visa, which means you can pursue legal permanent resident identity (i.e. green card) while under H-1B nonimmigrant status. 

Long Visa Validation Date

The H1B visa allows visa holders to stay up to 3 years initially and can easily be extended to 6 years. If you are not a green card applicant and want to keep working in the U.S. under H1B, you can leave the country for a year or more and reapply for the H1B.

Available For Employers Transfer

H-1B gives visa holders the ability to transfer from one employer to another sponsoring employer during their stay. Employers can choose to work either part-time or full-time jobs with or without payment for cap-exempt & non-exempt employers.

H1B Restrictions

The 6-year time restriction usually limits an alien worker from working in the U.S.. If employers want to continue working in the U.S. after those 6 years, one of the options is to stay outside of the U.S. for one year or longer and reapply for another H1B visa. If the employee chooses to stay overseas and reapply for H1b for a fresh 6 years, he or she would need to reenroll in the lottery.
